Terms and Conditions of the Mineralco P.S.A. Online Store

I. General Information

  1. The administrator and owner of the online store operating at www.petsdiag.com is Mineralco P.S.A. with its registered office in Katowice (address: ul. 11 Listopada 11, 40-387 Katowice), entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Katowice – Wschód in Katowice, VIII Commercial Division of the National Court Register under KRS number 0001074590, NIP 6342963590, REGON 383731860, share capital in the amount of PLN 158,900.
  2. These Terms and Conditions define the conditions for the sale of testing kits and consultations of the above-mentioned results via the online store www.petsdiag.com to consumers, as well as to entities that are not consumers, who are entrepreneurs – within the meaning of the Act of 2 July 2004 on Freedom of Economic Activity (consolidated text: Journal of Laws 2010 No. 220 item 1447, as amended) – and purchase these goods in connection with their business activity.
  3. The provisions of sections X and XII.1, 2, 3 and 4 of these Terms and Conditions, which contain consumer rights resulting from the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 24 June 2014, item 827), do not apply to entities that are not consumers.
  4. However, with regard to the rules concerning the submission of complaints and the conditions for termination of sales agreements concluded by entities that are not consumers, section XIII of these Terms and Conditions shall apply – these rules do not apply to consumers.

  6. Placing an order in accordance with these Terms and Conditions requires acceptance of these Terms and Conditions.

 

II. Definitions

  1. Sales Agreement – an agreement concluded by Mineralco P.S.A. with the Customer via the online store www.petsdiag.com in accordance with the procedure specified in these Terms and Conditions.
  2. Product – a testing kit, result consultation or supplement.
  3. Delivery – delivery by the Seller to the Customer of the ordered Product, constituting performance of the service commissioned to the Seller via the online store www.petsdiag.com on the basis of the Sales Agreement. Delivery is carried out using the services of an external provider (Polish Post, courier company). In the case of online testing kits, delivery is carried out electronically to the e-mail address provided by the Customer in the order.
  4. Customer – a purchaser of goods offered in the online store. The Customer may be a natural person with full legal capacity or a legal entity. The Customer may be a consumer or a non-consumer entity who is an entrepreneur – within the meaning of the Act of 2 July 2004 on Freedom of Economic Activity – and purchases goods in connection with their business activity.
  5. Terms and Conditions – these Terms and Conditions specifying the rules for placing orders by the Customer via the online store www.petsdiag.com and their execution by the Seller.
  6. Online Store – the online store operated by the Seller – Mineralco P.S.A., available at www.petsdiag.com.
  7. Seller – Mineralco P.S.A. with its registered office in Katowice, ul. 11 Listopada 11, 40-387 Katowice, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Katowice – Wschód in Katowice, VIII Commercial Division of the National Court Register under KRS number 0001074590, NIP 6342963590, REGON 383731860, share capital in the amount of PLN 158,900.
  8. Website – the website operated by the Seller at www.petsdiag.com.
  9. Release – occurs upon delivery of the Product to the Customer and its receipt or direct collection by the Customer or a third party indicated by them at the Seller’s premises.

 

III. Technical Requirements

  1. To make a purchase in the online store, the Customer should have:
    1. a computer or phone connected to the Internet,
    2. an Internet connection (broadband recommended),
    3. a web browser compatible with MS Internet Explorer 6.0, Firefox > 3, Opera 9, Google Chrome or newer with JavaScript enabled,
    4. an active e-mail account.

 

IV. Placing Orders

  1. Information provided on the website of the online store www.petsdiag.com does not constitute an offer within the meaning of the Civil Code of 23 April 1964 (Journal of Laws 1964 No. 16 item 93, as amended). This information constitutes an invitation for Customers to submit offers. Therefore, placing an order by the Customer alone is not sufficient to conclude a Sales Agreement. By completing the order process, the Customer submits an offer to purchase the Product. The distance Sales Agreement is concluded at the moment the Customer receives confirmation of acceptance of the order sent by the online store in the manner specified in section IV.7 of these Terms and Conditions.
  2. The terms of the Sales Agreement are defined by these Terms and Conditions, applicable law including the Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended), the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2002, No. 144, item 1204, as amended), any individual arrangements made between the Customer and the online store in connection with placing the order, and, in relation to consumers, also the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 24 June 2014, item 827).
  3. Orders may be placed 24 hours a day throughout the year via the online store. Orders placed on public holidays or non-working days will be processed in the order of receipt on the first working day following the day the order was placed.
  4. To browse the offer available in the online store, the Customer must visit https://www.petsdiag.com/us/usshop/. After entering the online store, the Customer may select any Product available. The Customer selects a product and completes the order form. After deciding to purchase the selected product, the Customer must confirm the order.
  5. In order to place an order via the online store, it is required to provide Customer data using the order form.
  6. Orders about which there are any doubts will be verified by the online store staff. The Customer will be informed about the verification process by phone or e-mail. If the Customer does not confirm the order details, the order will be canceled.
  7. Acceptance and commencement of order processing by the online store is confirmed by sending a confirmation to the Customer via e-mail to the address provided in the order form.
  8. By placing an order, the Customer confirms, by selecting the appropriate checkbox on the website, that they have read and accept these Terms and Conditions.
  9. The Seller issues a sales document, which is a receipt or a VAT invoice.

 

V. Terms of Delivery

  1. The Customer may choose the following delivery methods:
    1. delivery via Polish Post;
    2. delivery via courier service;
    3. delivery via e-mail to the address provided by the Customer in the order (applies to online testing kits).
  2. The delivery of online testing kits is carried out electronically to the e-mail address provided by the Customer in the order, after the payment has been credited to the Seller’s account.
  3. The delivery time when using courier service is five working days from payment confirmation, but no later than 30 days from order submission. Risk transfers upon delivery.
  4. The Customer or authorized person may check the shipment in the presence of the courier. Signing confirms compliance with the Sales Agreement.
  5. If damage is found, the Customer must prepare a damage report with the courier and inform the Seller. The Customer may refuse the shipment if concerns arise.

 

VI. Payment Methods

Customers may use the following payment method: payment via the TPay system.

 

VII. Prices and Delivery Costs

  1. All prices are expressed in United States dollars (USD) and include applicable taxes. Delivery of online testing kits via e-mail is free of charge. Any additional costs, if applicable, are indicated on the online store website.
  2. Prices are binding at the time of order placement.
  3. The Seller reserves the right to change prices and promotions, which do not affect already placed orders.

VIII. Discounts

Customers holding a partner code may receive a special discount. Promotional products cannot be combined with partner discounts.

IX. Personal Data Protection, Cookies, Newsletter

  1. The controller of your personal data is the Seller (Mineralco P.S.A. with its registered office in Katowice, Poland, ul. 11 Listopada 11, 40-387).
  2. Contact regarding personal data is possible via e-mail: iod@petsdiag.com.
  3. Personal data may be processed for the following purposes:
    1. processing and fulfilling orders placed in the petsdiag.com store,
    2. creating and managing an account at petsdiag.com,
    3. sending marketing communications, including newsletters (with your consent).
  4. Depending on the processed data, recipients of personal data may include entities providing:
    1. courier services – for order delivery,
    2. hosting services – for order processing, account administration and communication,
    3. IT services – for account administration,
    4. newsletter services – for marketing communication,
    5. accounting services – for order processing.
  5. Personal data is not transferred in a way that violates applicable data protection laws.
  6. Data retention:
    1. account data will be retained as required by applicable tax and accounting regulations after account deletion request,
    2. newsletter data will be deleted after unsubscribe,
    3. correspondence data retained for up to 5 years or as required for legal claims.
  7. The Customer may have the right to access, correct, delete, restrict processing, transfer data, object to processing, and withdraw consent where applicable.
  8. If you are a resident of certain U.S. states (such as California), you may have additional privacy rights under applicable laws.
  9. Providing personal data is voluntary but may be required for account creation and order processing.
  10. The Customer subscribing to the newsletter:
    1. agrees to receive marketing and promotional emails,
    2. consents to data processing for marketing purposes,
    3. may unsubscribe at any time using the link provided in each email.
  11. Cookies are used to operate the website, analyze traffic, and personalize content and advertising. The user may disable cookies in the browser, which may affect functionality. Details are provided in the Privacy Policy.

X. Withdrawal from the Sales Agreement (Consumers)

The Customer has the right to withdraw from the Sales Agreement within 14 (fourteen) days without giving any reason, by submitting a written statement to the Seller.

XI. Product Descriptions

The Seller declares that product descriptions are accurate and reflect the actual state.

XII. Complaints (Consumers)

  1. If within 24 months the Product is found non-compliant, the Seller will replace it.
  2. The Seller is liable if the Product was non-compliant at delivery.
  3. The Customer must notify within 2 months.
  4. Shipping costs reimbursed if complaint accepted.
  5. Complaints processed within 14 days.
  6. Replacement, price reduction or refund possible.

 

XIII. Liability for Non-Consumers

  1. Non-consumers are subject to general warranty rules.
  2. Claims must be reported within 7 days.
  3. Liability limited to actual damage.
  4. Relevant provisions apply.
  5. General law applies.
  6. Exceptions apply.

 

XIV. Final Provisions

  1. The Seller reserves the right to amend these Terms and Conditions. The amended version shall be published and become effective after 7 days.
  2. Applicable provisions of Polish law apply.
  3. Disputes will be resolved amicably or by a competent court.
  4. Consumers may obtain assistance from consumer protection institutions.
  5. Alternative dispute resolution methods are available.
  6. These Terms and Conditions shall be governed by Polish law.
